1) Introduction and Overview

These Terms of Use (“Terms”) are a legal agreement between you and Patricia Prior (“Patricia Prior,” “we,” “us,” or “our”) and govern your access to and use of our website, shop, newsletters, and any online services that link to these Terms (collectively, the “Service”).

2) Eligibility and Key Rules

  • You must be at least 16 years old to use the Service.

  • You are responsible for keeping your devices and login details secure.

  • You agree to use the Service lawfully and respectfully, and not to:

    • break any law or infringe any third-party rights;

    • post or transmit anything unlawful, harassing, defamatory, obscene, hateful, or harmful;

    • attempt to access non-public areas, interfere with security, or reverse-engineer any part of the Service;

    • use the Service to advertise or conduct commercial activity not expressly authorised by us.

We may suspend or end your access if we reasonably believe these Terms are breached.

3) Our Content and Your Licence to Use the Site

All content on the Service—books, excerpts, images, cover art, graphics, videos, text, logos, trademarks, layout and “look and feel” (collectively, “Content”)—is owned by us or our licensors and protected by intellectual property laws.

We grant you a limited, non-exclusive, revocable, non-transferable licence to access and view the Service and to print one copy of pages for personal, non-commercial use only. No rights are granted to reproduce, distribute, adapt, publish, or create derivative works from the Content without written permission.

4) Your Content (if you submit anything)

If you submit or post content to us (e.g., reviews, comments, contest entries), you:

  • confirm you own or have rights to share it;

  • grant us a worldwide, royalty-free, non-exclusive licence to use, display, reproduce, and share it in connection with the Service and our social channels; and

  • agree not to submit anything unlawful or infringing.
    We may moderate or remove submissions at our discretion.

5) Third-Party Services and Links

The Service may include links to or integrations with third-party platforms (e.g., payment providers, analytics, social media). Those services are governed by their own terms and privacy policies. We are not responsible for third-party sites or services.

6) E-Commerce (Shop)

a) Orders and Contract

Placing an order is an offer to buy. We’ll confirm acceptance by email (or by dispatch). We may decline or cancel an order (e.g., pricing error, stock issues, suspected fraud).
You are responsible for providing accurate shipping/billing details.

b) Prices, Taxes, and Payment

Prices are shown in the currency stated on the site and include/exclude taxes as indicated at checkout. Any delivery charges are shown separately. Payments are processed securely by Stripe/PayPal/Squarespace Payments; we do not store card details.

c) Shipping and Delivery

Estimated delivery times are guidelines, not guarantees. Risk in physical goods passes to you on delivery.

d) Pre-Orders

Pre-order dates are estimates and may change. We will fulfil once stock is available or issue a refund if we cannot complete the order.

e) Digital Products

For digital downloads, access is typically provided promptly after purchase. By downloading/streaming, you consent to immediate performance and acknowledge you lose the 14-day right to cancel (see “Consumer Cancellations” below).

f) Returns, Exchanges, and Faulty Goods

Please see our Returns/Refunds Policy (if posted).

  • Faulty or misdescribed goods: you have statutory rights to a repair, replacement, or refund under UK law.

  • Change of mind: see “Consumer Cancellations” below.
    Contact us with order number, photos (if relevant), and your request.

g) Promotions and Discount Codes

Promotions are time-limited, subject to availability, and may be withdrawn or varied at any time. Codes are non-transferable and may not be used with other offers unless stated.

7) Consumer Cancellations (UK/EU)

If you are a consumer in the UK/EU and buy physical goods online, you generally have 14 days from receipt to cancel without giving a reason. You must notify us within this period and return items within 14 days of notifying cancellation. You are responsible for return postage unless goods are faulty. We will refund the product price and the standard delivery cost (not any premium shipping) within 14 days of receiving the returned goods or proof of return.

Exceptions: The right to cancel does not apply to:

  • digital content after download/streaming has begun (where you consented to immediate performance and acknowledged losing the right to cancel);

  • personalised, custom, or sealed items not suitable for return once unsealed (books signed/personalised to you, for example).
    Your statutory rights for faulty goods remain unaffected.

8) Newsletter, Emails, and Marketing

You can opt in to receive emails (news, releases, events, promotions). You may unsubscribe at any time via the link in the email or by contacting us. See our [Privacy Policy] for details on how we process personal data.

9) Site Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may change, suspend, or withdraw any part of the Service (including products, features, or prices) at any time.

10) Disclaimer

To the maximum extent permitted by law, the Service and Content are provided “as is” and “as available”. We do not promise the Service will be error-free or that content is complete or current. Nothing in these Terms limits or excludes any statutory consumer rights that cannot be excluded by law.

11) Limitation of Liability (UK)

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be limited.

Subject to the above, we will not be liable for: (a) loss of profit; (b) loss of sales or business; (c) loss of data; (d) loss of goodwill; or (e) any indirect or consequential loss. For paid transactions, our total liability relating to a specific order is limited to the amount you paid for that order.

12) Indemnity (if you misuse the Service)

You agree to indemnify us for reasonable losses, costs, and expenses arising from your breach of these Terms or infringement of third-party rights, except to the extent caused by our negligence or breach.

13) Intellectual Property Concerns

If you believe any Content infringes your rights, contact privacy@authorpatriciaprior.com with details (work claimed, location on the site, and your contact info). We may remove or disable access while we review.

14) Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction. If you live in Scotland or Northern Ireland, you can bring proceedings in your local courts.

15) Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on the Service with an updated “Effective Date.” If you continue using the Service after changes are posted, you accept the updated Terms.

16) Miscellaneous

  • Severability: If any part of these Terms is invalid, the rest remains in force.

  • No waiver: A delay or failure to enforce a right is not a waiver.

  • Assignment: You may not assign your rights under these Terms. We may assign our rights as part of a reorganisation or sale.

  • Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.

  • Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (e.g., strikes, shortages, transport failures, epidemics, natural disasters, or government action).
